The National Football League (NFL) recently settled a class action lawsuit with former NFL players who have developed chronic traumatic encephalopathy (CTE). As a result of their time spent playing in the NFL. The settlement amounts to $1 billion dollars and qualifying former players are eligible to collect up to $5 million dollars in damages from the settlement.
CTE is a degenerative brain disease frequently found in athletes who play or played contact physical sports. The disease has been found in football players, rugby players, boxers, and hockey players among others. CTE is a very serious condition and in advanced cases can cause dementia, vertigo, deafness, and speech impairment in addition to other symptoms. CTE has even been found in high school football players. In numerous cases, individuals who suffered from CTE have committed suicide, and suicidality is considered a symptom of the disease.
Evidence of CTE, formally called dementia pugilistica, has existed for many years. Going back as far as the 1950’s medical professionals expressed concern over the sport of boxing because they saw signs that the frequent head trauma would often lead to diseases of the brain, sometimes years or even decades after the athlete had competed. The NFL has been criticized for its failure to acknowledge CTE even in the face of decades’ worth of evidence.
After facing a high profile lawsuit regarding the high instances of CTE in the NFL, former players and the league came to the $1 billion dollar settlement. A retired player does not have to have been a part of the initial lawsuit in order to collect.
For former NFL players who wish to collect from the settlement, the process involves filing for paperwork and presenting medical evidence indicating that the player is in fact suffering from CTE. Thus one of the first steps in the process is to undergo a medical examination with a neurologist in order to determine if you qualify. By retaining an attorney, you can be sure that you are undergoing the correct tests, and gathering all of the information necessary to make your claim to collect from the settlement.
