I was deliberately injured or attacked by another passenger. Who is responsible?
If another passenger deliberately causes you harm, you should report this immediately to the staff present on the train as well as to law enforcement. Obviously, a person who deliberately causes you injury is responsible for his or her actions. Train personnel are not able to prevent all instances where injuries are inflicted on passengers by other passengers. However, if the train company did not provide enough staff to staff the train and reasonably observe the behavior of other passengers, in that circumstance the train company may be responsible. In addition, if you are repeatedly victimized on a train and staff present on the train did nothing in response to your complaints, the train company may be responsible for your losses and expenses.
