Should I settle my bicycle injury claim?
After a bicycling injury, you may be approached by the at-fault party or his or her insurance company and be asked to settle your claim. The at-fault party and/or his or her insurer will offer you a sum of money in exchange for your promise to either dismiss your lawsuit (if it has already been filed) or not to file a lawsuit. Settlements may be seen as beneficial in that they provide money to the injured bicyclist quickly. However, you waive important legal rights by accepting a settlement. Moreover, you may be accepting a settlement amount that is far less than the amount you need to pay for your expenses and losses. For these reasons, you should seek out legal counsel before deciding to accept a proposed settlement offer.
